Términos de Uso y EULA

Lee atentamente estos Términos de Uso ("Términos") antes de usar la aplicación TrainerUPP para iPhone y Apple Watch ("App"), operada por APPLOAD LLC ("nosotros" o "nuestro").

1. Aceptación de los Términos

Al descargar, instalar o usar TrainerUPP, aceptas quedar vinculado por estos Términos y por nuestra Política de Privacidad. Si no estás de acuerdo con alguna parte de los términos, no puedes usar la App.

2. Salud y seguridad

2.1 No es asesoramiento médico

TrainerUPP es una herramienta para planificar y registrar tus propios entrenamientos. No ofrece asesoramiento médico, sanitario ni de entrenamiento profesional, y no es un dispositivo médico. Nada de lo que aparece en la App, incluidos los tiempos de descanso, los objetivos de repeticiones, las sugerencias de peso ("Prueba X"), las estadísticas de progreso y la calculadora de discos, es una recomendación de que un ejercicio o una carga concretos sean seguros o adecuados para ti.

2.2 Consulta a un profesional

Consulta a un médico u otro profesional sanitario cualificado antes de empezar cualquier programa de ejercicio o de cambiar tu entrenamiento, sobre todo si estás embarazada, te estás recuperando de una lesión o tienes una afección cardíaca, hipertensión o cualquier otra condición médica.

2.3 Tu responsabilidad

El ejercicio, y en especial el entrenamiento con pesas, conlleva riesgo de lesión. Tú eliges los ejercicios, los pesos y la intensidad, y lo haces bajo tu propio riesgo.
Usa una técnica correcta, calienta, usa un compañero de seguridad o equipo de protección cuando corresponda, y detente de inmediato si sientes dolor, mareo, desvanecimiento o falta de aire.
Las sugerencias de peso y los cálculos de discos se generan automáticamente a partir de los números que introdujiste. Comprueba siempre tú mismo el peso de la barra o la máquina antes de levantarlo.
No uses la App, ni mires tu iPhone o Apple Watch, de una forma que te distraiga mientras levantas peso o te mueves.

3. Acuerdo de licencia de usuario final (EULA)

3.1 Concesión de licencia

APPLOAD LLC te concede una licencia limitada, no exclusiva, intransferible y revocable para usar la App en dispositivos de la marca Apple que poseas o controles, según lo permitido por las Reglas de uso de los Términos y condiciones de los Servicios multimedia de Apple y con sujeción a estos Términos.

3.2 Restricciones

No puedes:

Copiar, modificar o distribuir la App, ni ninguna de sus imágenes u otro contenido.
Aplicar ingeniería inversa, descompilar o desensamblar la App, salvo en la medida en que la ley aplicable lo permita expresamente.
Eliminar avisos de derechos de autor o de propiedad.
Sublicenciar, vender, alquilar, arrendar o transferir la licencia a terceros.
Usar la App para cualquier fin ilícito.

4. Tus datos

4.1 Son tuyos

Conservas todos los derechos sobre las rutinas, entrenamientos, notas y demás información que introduces en TrainerUPP. No reclamamos ningún derecho sobre tu contenido y no tenemos acceso a él: se guarda en tus dispositivos y, si lo eliges, en tu propia cuenta de iCloud y en Apple Health. No operamos ningún servidor que pueda recibirlo.

4.2 Las copias de seguridad son tu responsabilidad

TrainerUPP ofrece una copia de seguridad opcional en iCloud y archivos de copia que puedes exportar. Como nunca guardamos una copia de tus datos, no podemos recuperarlos si pierdes o restableces tu dispositivo, eliminas la App, o una copia falta o se sobrescribe. Crear copias de seguridad y mantenerlas a salvo es tu responsabilidad. Importar una copia o restaurar desde iCloud reemplaza los datos que haya en la App.

4.3 Archivos que compartes

Las copias exportadas y las rutinas compartidas son archivos sin cifrar. Tú eres responsable de a quién se los envías. También eres responsable de cualquier rutina o copia que importes, y solo deberías importar archivos de fuentes en las que confíes.

5. Apple Watch, Apple Health e iCloud

Algunas funciones dependen de servicios y hardware de Apple: la app para Apple Watch, Apple Health, iCloud, las Actividades en vivo y los widgets. Los proporciona Apple y se rigen por sus propios términos y política de privacidad, no por los nuestros. No somos responsables de su disponibilidad, y las funciones que dependen de ellos pueden no funcionar en todos los dispositivos o regiones. 8. Limitación de responsabilidad

9. App Store de Apple

Reconocimiento: estos Términos se celebran únicamente entre tú y APPLOAD LLC, no con Apple. APPLOAD LLC, y no Apple, es el único responsable de la App y su contenido.
Mantenimiento y soporte: APPLOAD LLC es el único responsable de prestar mantenimiento y soporte para la App. Apple no tiene obligación alguna de prestar servicios de mantenimiento ni de soporte para la App.
Garantía: si la App no cumple alguna garantía aplicable, puedes notificarlo a Apple, que te reembolsará el precio de compra, si lo hubiera. En la máxima medida permitida por la ley, Apple no tendrá ninguna otra obligación de garantía respecto a la App.
Reclamaciones sobre el producto: APPLOAD LLC, y no Apple, es responsable de atender cualquier reclamación tuya o de terceros relacionada con la App o con su posesión o uso, incluidas las reclamaciones por responsabilidad del producto, las reclamaciones de que la App no cumple algún requisito legal o normativo, y las reclamaciones derivadas de la legislación de protección del consumidor, de privacidad o similar, incluso en relación con el uso de HealthKit por parte de la App.
Reclamaciones de propiedad intelectual: si un tercero alega que la App o su uso infringe sus derechos de propiedad intelectual, APPLOAD LLC, y no Apple, será el único responsable de la investigación, defensa, resolución y liquidación de esa reclamación.
Cumplimiento legal: declaras que no te encuentras en un país sujeto a embargo del Gobierno de EE. UU. ni designado como país que "apoya el terrorismo", y que no figuras en ninguna lista de partes prohibidas o restringidas del Gobierno de EE. UU.
Términos de terceros: debes cumplir los términos de terceros aplicables, como los de tu operador de telefonía móvil, al usar la App.
Tercero beneficiario: Apple y sus filiales son terceros beneficiarios de estos Términos y, una vez que los aceptes, Apple tendrá derecho a hacerlos valer frente a ti.

10. Terminación

Podemos rescindir o suspender tu licencia de inmediato, sin previo aviso, si incumples estos Términos. Tras la terminación, tu derecho a usar la App cesará de inmediato. Tus datos siguen siendo tuyos; exporta una copia antes de eliminar la App.

11. Ley aplicable

Estos Términos se regirán por las leyes de los Estados Unidos de América y de Israel, sin tener en cuenta sus normas sobre conflicto de leyes. Nada de lo dispuesto en estos Términos limita los derechos que te otorguen las leyes imperativas de protección del consumidor del país en el que vives.

12. Cambios en los Términos

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Te avisaremos de los cambios importantes actualizando la "Fecha de entrada en vigor" y, si los cambios son significativos, en la App.

הקפד/י על טכניקה נכונה, בצע/י חימום, היעזר/י בשומר/ת או בציוד בטיחות כשמתאים, והפסק/י מיד אם את/ה חש/ה כאב, סחרחורת, חולשה או קוצר נשימה.
הצעות המשקל וחישובי הפלטות נוצרים אוטומטית מהמספרים שהזנת. בדוק/י תמיד בעצמך את המשקל על המוט או על המכשיר לפני ההרמה.
אל תשתמש/י באפליקציה, ואל תסתכל/י ב‑iPhone או ב‑Apple Watch, באופן שמסיח את דעתך בזמן הרמה או תנועה.

3. הסכם רישיון למשתמש קצה (EULA)

3.1 הענקת רישיון

APPLOAD LLC מעניקה לך רישיון מוגבל, לא בלעדי, שאינו ניתן להעברה וניתן לביטול, להשתמש באפליקציה במכשירים ממותגי Apple שבבעלותך או בשליטתך, כפי שמתירים כללי השימוש שבתנאים ובהגבלות של Apple Media Services ובכפוף לתנאים אלה.

5. ‏Apple Watch, ‏Apple Health ו‑iCloud

תנאי צד שלישי: עליך לעמוד בתנאי צד שלישי החלים עליך בעת השימוש באפליקציה, כגון תנאי ספק הסלולר שלך.
מוטב צד שלישי: Apple וחברות הבת שלה הן מוטבות צד שלישי של תנאים אלה, ומרגע שקיבלת אותם, ל‑Apple הזכות לאכוף אותם כלפיך.

10. סיום

אנו רשאים לסיים או להשעות את הרישיון שלך באופן מיידי וללא הודעה מוקדמת אם הפרת תנאים אלה. עם הסיום, זכותך להשתמש באפליקציה תפקע מיד. הנתונים שלך נשארים שלך; ייצא/י גיבוי לפני מחיקת האפליקציה.

11. הדין החל

12. שינויים בתנאים

אנו שומרים לעצמנו את הזכות לשנות תנאים אלה בכל עת. נודיע לך על שינויים מהותיים באמצעות עדכון "תאריך התחולה", ואם השינויים משמעותיים, גם באפליקציה.

Please read these Terms of Use ("Terms") carefully before using the TrainerUPP application for iPhone and Apple Watch ("App") operated by APPLOAD LLC ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using TrainerUPP, you agree to be bound by these Terms and by our Privacy Policy. If you disagree with any part of the terms, you may not use the App.

2. Health and Safety

2.1 Not Medical Advice

TrainerUPP is a tool for planning and logging your own workouts. It does not provide medical, health or professional fitness advice, and it is not a medical device. Nothing in the App, including rest times, rep targets, weight suggestions ("Try X"), progress statistics and the plate calculator, is a recommendation that a particular exercise or load is safe or suitable for you.

2.2 Consult a Professional

Consult a physician or other qualified health professional before starting any exercise program or changing your training, especially if you are pregnant, are recovering from an injury, or have a heart condition, high blood pressure or any other medical condition.

2.3 Your Responsibility

Exercise, and weight training in particular, carries a risk of injury. You choose the exercises, weights and intensity you use, and you do so at your own risk.
Use proper form, warm up, use a spotter or safety equipment where appropriate, and stop immediately if you feel pain, dizziness, faintness or shortness of breath.
Weight suggestions and plate calculations are generated automatically from the numbers you entered. Always check the weight on the bar or machine yourself before lifting.
Do not use the App, or look at your iPhone or Apple Watch, in a way that distracts you while lifting or moving.

3. End User License Agreement (EULA)

3.1 Grant of License

APPLOAD LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions and subject to these Terms.

3.2 Restrictions

You may not:

Copy, modify, or distribute the App, or any of its images or other content.
Reverse engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits it.
Remove any copyright or proprietary notices.
Sublicense, sell, rent, lease or transfer the license to third parties.
Use the App for any unlawful purpose.

4. Your Data

4.1 It Is Yours

You retain every right to the routines, workouts, notes and other information you enter in TrainerUPP. We claim no rights over your content and we have no access to it: it is stored on your devices, and, if you choose, in your own iCloud account and Apple Health. We operate no server that could receive it.

4.2 Backups Are Your Responsibility

TrainerUPP offers an optional iCloud backup and backup files you can export. Because we never hold a copy of your data, we cannot recover it if your device is lost or reset, the App is deleted, or a backup is missing or overwritten. Creating backups and keeping them safe is your responsibility. Importing a backup or restoring from iCloud replaces the data currently in the App.

4.3 Files You Share

Exported backups and shared routines are unencrypted files. You are responsible for whom you send them to. You are also responsible for any routine or backup file you import, and you should only import files from sources you trust.

5. Apple Watch, Apple Health and iCloud

Some features depend on Apple services and hardware: the Apple Watch app, Apple Health, iCloud, Live Activities and widgets. These are provided by Apple and governed by Apple's own terms and privacy policy, not ours. We are not responsible for their availability, and features that rely on them may not work on every device or in every region. The accuracy of timers, alerts and haptics can be affected by your device's settings, battery state and connection between iPhone and Apple Watch.

6. Intellectual Property

The App and its original content, features, and functionality, including its exercise images and illustrations, are owned by APPLOAD LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. TrainerUPP is a trademark of APPLOAD LLC. Apple, Apple Watch, Apple Health and iCloud are trademarks of Apple Inc.

7. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the App will be error-free or uninterrupted, that calculations, timers or statistics will be accurate, or that data stored in it will never be lost.

8. Limitation of Liability

To the maximum extent permitted by applicable law, APPLOAD LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of, or inability to use, the App. To the maximum extent permitted by applicable law, APPLOAD LLC is not liable for any injury, illness or damage resulting from exercise or physical activity you undertake, whether or not it was planned or logged in the App. Some jurisdictions do not allow these limitations, so they may not apply to you.

9. Apple App Store

Acknowledgement: These Terms are between you and APPLOAD LLC only, not Apple. APPLOAD LLC, not Apple, is solely responsible for the App and its content.
Maintenance and support: APPLOAD LLC is solely responsible for providing maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services for the App.
Warranty: If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
Product claims: APPLOAD LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation, including in connection with the App's use of HealthKit.
Intellectual property claims: If a third party claims that the App or your use of it infringes their intellectual property rights, APPLOAD LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.
Legal compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Third-party terms: You must comply with any applicable third-party terms, such as your mobile carrier's, when using the App.
Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them Apple has the right to enforce them against you.

10. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App will cease immediately. Your data remains yours; export a backup before deleting the App.

11. Governing Law

These Terms shall be governed by the laws of the United States of America and Israel, without regard to conflict of law provisions. Nothing in these Terms limits any rights you have under the mandatory consumer protection laws of the country where you live.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective date" and, if the changes are significant, in the App.
